SUMMARY

This workshop helps attendees to protect their rights and ultimately their premium dollars by developing a better understanding of the subrogation process. The workshop will show them how to lower Workers' Compensation, liability, and property exposures and facilitate subrogation. LEARNING OBJECTIVES When it isn't the employer or the employee who is responsible for an on-the-job injury or property damage, the insurer may pursue the party who is at fault to recover claim payments. This process is known as subrogation and it an important way for CIRMA to lower its members' claims costs. In 2007-08 alone, CIRMA recovered over $3.6 million through subrogation- this represents an aggregate 4.5% savings in premiums costs to members.

This CIRMA workshop describes the important steps that you as a municipal or school leader can take to help CIRMA preserve its ability to subrogate claims, and thus protect your rates.

Before a claim occurs:

  • Reviewing contracts, leases, and policies for subrogation potential or waiver of subrogation rights;
  • Reviewing lease agreements or construction contracts for indemnification language or to determine what control is retained, with an aim to reducing your risk exposure; and
  • Setting proper authority to sign contracts.

And after an accident:

  • Preserving evidence and obtaining statements from witnesses;
  • Proper filing of First Report of Injury
  • Securing a defective product that may have caused the injury.
  • Statute of limitations.

The workshop also details what you as a municipal or school leader should do to when an injured worker brings suit against an at-fault third party.

SPEAKERS Heather J. Adams-Beman
Skelly-Rottner, PC, Partner
Ms. Adams-Beman is a civil litigation attorney with a focus in subrogation, as well as insurance defense, including first-party and third-party claims and insurance coverage disputes. She has assisted a number of insurance carriers in claims investigations, fraud investigations, and coverage opinions. Additionally she has defended several insurance carriers in litigation related to coverage disputes, bad faith, unfair trade and insurance practice claims. She also has experience litigating both property and Workers’ Compensation subrogation litigation. Ms. Adams-Beman is a member of the Connecticut and the American Bar Associations. She is a graduate of the University of Hartford, B.A., and the Western New England College School of Law, J.D.

Allison A. Bergan
Skelly-Rottner, PC, Associate

Ms. Bergan joined the firm in 2008 and is presently handling a broad range of matters including Worker’s Compensation and property subrogation matters. Prior to joining the firm Ms. Bergan was employed as a clerk for the Middlesex Superior Court. Ms. Bergan graduated from University of Connecticut with a B.A. in Political Science and received her law degree from Suffolk University in 2007.

Wanda Wilkins
CIRMA, Recovery Specialist

Wanda has worked in the Property/Casualty Insurance industry since 1981. Her multi-Line (Personal & Commercial lines) claims handling experience includes General Liability, Workers' Compensation, Bodily Injury, Auto, Homeowners & Products Liability. She has twelve years of Claims Management experience and is currently a Recovery Specialist at CIRMA.

Take the US-6 exit, EXIT 39, toward CT-222/ Thomaston/Bristol. Turn left onto East Main Street/US-6. 158 Main Street is on the right.

From the HARTFORD AREA: Take I-84 West. Merge onto US-6 West/ Main Street via Exit 38 toward Bristol. 158 Main Street is on the right.

From the NORWICH AREA: Take CT-2/CT-32 West. Continue to follow CT-2/CT-32, then merge onto I-84 W/US-6 W via Exit 2/West toward I-91 North. Merge onto US-6 W via Exit 38 toward Bristol. 158 Main Street is on the right.
