Municipal Construction Projects: Managing Risks, Costs, & Schedules This workshop is part of CIRMA’s Management Series. These workshops provide managers and supervisors with the understanding and skills they need to develop a more effective risk management program.

LEARNING OBJECTIVES
School buildings, police and fire stations, roads, and bridges are
complex, big-ticket construction projects that come with some
big risks to the municipal owner. Even a small renovation or
building project may experience cost overruns, or delays, or contribute
to a serious workplace injury.
In this new CIRMA workshop, attorney Timothy S. Fisher
and Kenneth E. Fargnoli, PE, present risk management strategies
that municipal leaders can use to control costs, stay on schedule,
and reduce the risk of litigation in construction projects. These
best practices will help public officials:
Build more cooperative teamwork and stronger communication to resolve disagreements smoothly;
Select qualified design professionals and consultants;
Manage the bidding process and select the appropriate project delivery system; and
Select the appropriate contract forms and insurance
coverage to manage liability
The instructors will show you how to reduce the risk—and the loss costs—associated with:
Personal injury, property loss, and economic loss during the construction project;
Environmental issues, assessments, and compliance;
Breach-of-contract and negligence by contractors; and
Contract claims for disputes associated with change orders, differing site conditions, and delays.

SPEAKERSTimothy S. Fisher, Esq. McCarter & English, LLP
Timothy S. Fisher is a partner at McCarter & English LLP, a firm
of 400 lawyers with offices in Massachusetts, Connecticut, New
York, New Jersey, Pennsylvania, and Delaware. He has represented
all parties to construction projects, including owners, general
contractors, subcontractors, unions, sureties, lenders, and design
professionals. He has written and taught extensively in the fields
of construction, municipal law, and alternative dispute resolution.
He chairs the Construction Advisory Council of the American
Arbitration Association for this region of the country, is past Chair
of the Connecticut Bar Association's Alternative Dispute Resolution
Section, and served on the Executive Committee of the Construction
Law Section. He is a 1975 graduate of Yale University and
received his J.D. from Columbia Law School in 1978.
Kenneth E. Fargnoli, PE Connecticut Department of Transportation
Kenneth E. Fargnoli, PE, has over 29 years of construction engineering
experience. He works as the Assistant District Engineer
in District 4 where he schedules, assigns, oversees, and reviews
staff. He has over 12 years experience leading the claims and litigation
unit of the Connecticut Department of Transportation
where he analyzed, supervised, and oversaw the analysis of over
70 construction claims exceeding $300 million in value. He is an
Arbitrator and Mediator for the American Arbitration Association.
Brian P. Rice, Esq. McCarter & English, LLP
Brian P. Rice is an associate at McCarter & English, LLP with
over 5 years of experience in construction and surety matters. He
has represented owners, design professionals, general contractors,
subcontractors, and suppliers in disputes arising from construction
contracts. He serves on the Connecticut Bar Association’s
House of Delegates, the Executive Committee of the Construction
Law Section, and the Legislation Review Committee.

From I-95, take I-91, Exit 48, north toward Hartford. Take the CT-372
exit, Exit 21, toward Cromwell/Berlin. Turn left onto Berlin Road/CT-
372. Turn left onto Coles Road. Fire Department Building is on
the left.
From the Southeast:
Take I-95 south, then merge onto CT-9 North via Exit 69 toward
Essex/Hartford. At Exit 19, turn left onto CT-372/West Street. Continue
on CT-372/West Street. Turn right onto Coles Road. Fire Department
Building is on the right.
From the North/Greater Hartford area:
Take Route 91 South to Exit 22S (Route 9: Cromwell - Middletown).
Take Exit 19 off Route 9, and turn left onto West Street. Continue on CT-
372/West Street. Turn right onto Coles Road. Fire Department Building
is on the right.
