Drug & Alcohol Testing Regulations for Supervisors

DESCRIPTION
This workshop focuses on the signs of probable alcohol
abuse and drug use by safetysensitive
employees and the
responsibilities of supervisors and managers to make a
reasonable suspicion determination.
Supervisors will learn the physical, behavioral and performance
indicators, as well as the collection process, for alcohol
and controlled substances according to US Department of
Transportation Regulations. This workshop meets federal
regulations (FMCSA and FTA) which require supervisory
training. The workshop is designed for both the new
supervisor and veteran who may need a refresher on D&A
determination skills.
PROGRAM
What Do Supervisors Need to Know?
- Understand DOT requirements for urine testing for drugs
and breath testing for alcohol
- Learn signs and symptoms of alcohol misuse and
substance abuse
- Outline supervisor responsibility for reasonable suspicion
testing
- Learn how to respond when an employee tests positive
What Are the Legal Considerations?
- Employer liability, insurance, contracts, and
indemnification
- Interaction with other laws: ADA & FMLA
- Reasonable suspicion testing
- Collective bargaining issues
WHO SHOULD ATTEND
- First Selectmen,Town/City Managers and others responsible for compliance with DOT regulations
- Supervisors of municipal transportation functions (paid or volunteer covered by DOT rules public works, recreation, social services, and education)
- Town/City Attorneys
