This CIRMA workshop provides participants information
about recent changes in the law regarding the complex area of
retaliation claims, and discusses various tools and procedures
employers can use to protect themselves.

understand the ever-changing legal landscape in which
they work.
This series of workshops provide managers and supervisors
the understanding they need to develop a more effective
risk management program.

LEARNING OBJECTIVES
This CIRMA workshop provides attendees insight into the
recent changes in the law regarding employment discrimination
and the definition of “adverse employment.”
Employers have a legitimate right to evaluate employee
performance and to take action regarding employment. However,
when those actions coincide with a charge of employment
discrimination, the employer should be prepared to disprove
retaliatory intent. The recent White v. Burlington Northern
decision sets a much looser standard that leaves employers the
task of carefully weighing their actions towards employees.
This new CIRMA workshop discusses proper ways to address
performance issues. The workshop also shows how an ombudsman
can help resolve issues before they become legal problems through
problem solving, open discussion, and mediation.

- What is retaliation?
- What is an “adverse employment” action.
- How have the courts interpreted the loose standard
recently articulated by the Supreme Court in White v.
Burlington Northern?
- How to properly investigate discrimination complaints?
- How to properly address performance issues that predate
or postdate any internal complaint or Commission on
Human Rights and Opportunities filing?
- How can the use of an ombudsman protect the employer
by forestalling retaliation claims?

Michael Rose, esq.
Rose Kallor, LLP
Attorney Rose is a principal at the law firm of
Rose Kallor, LLP. Attorney Rose advises
employers in all aspects of labor and employment
law. He also specializes in defending
private and municipal corporations in employment
disputes. He has defended employers before various administrative
agencies, the Connecticut Superior, Appellate and
Supreme Court, the United States District Court for the
District of Connecticut, and the United States Court of
Appeals for the Second Circuit.

DIRECTIONS
From HARTFORD: Take Route 2 East to Exit 18. At the end of
the Exit 18 ramp, turn right onto Route 16 and continue to the
center of town. At the traffic light, turn left onto Norwich Avenue.
The Town Hall is approximately 1/4 mile up Norwich Avenue on left.
From MIDDLETOWN: Take Route 66 East to Route 16 East.
Follow Route 16 East to the center of town. At the traffic light, turn
right onto Route 85 East. At the first light, turn left onto Norwich
Avenue. Town Hall is approximately 1/4 mile up Norwich Avenue
on the left.
From NORWICH: From Route 2 West, take Exit 21 - Colchester
Business District. At the end of the Exit 21 ramp, turn left onto
Norwich Avenue. Continue on Norwich Avenue for 2+ miles, past
Bacon Academy High School on your right, then William Johnson
Middle School on the left. Continue 1/10th of a mile; at the base
of the hill, Town Hall is on the right.
