The Americans With Disabilities Act: Titles I & II

SUMMARY
This workshop addresses the employer’s relationship with and
responsibilities to disabled, but otherwise qualified, employees,
and the accommodations local governments must make to the
disabled public.

The Americans With Disabilities Act: Titles I & II was
developed to help managers better understand the Act itself
and its current interpretation and application.
This workshop is part of CIRMA Management Series; these
workshops provide managers and supervisors the
understanding they need to develop a more effective risk
management program.

LEARNING OBJECTIVES
This CIRMA workshop guides attendees through the many
legal requirements that Titles I and II of the Americans With
Disabilities Act place on local governments.
The first part of the workshop addresses Title I and the
responsibilities of employers to their disabled employees. A
municipal leader’s failure to understand and implement correct
employment practices may lead to liability claims, the loss of
productive employees, and controversy in the workplace and
community
This workshop will clarify the many aspects of the
law including:
- What is a "disability," and when does an impairment
become a disability?
- What are employer’s roles and responsibilities to the
disabled employee?
- Appropriate questions to ask during and after hiring
The second part discusses Title II, which requires local
governments to make reasonable accommodations in their
programs and services to members of the public with disabilities.
While the cost of making structural changes often focuses leader’s
attention to making buildings accessible to the physically
handicapped, accessibility is a broader issue. Full accommodation
requires looking at how programs, services, and activities are
delivered to people with a range disabilities.
This section of the workshop addresses:
- When meetings and events should be moved or modified
to accommodate the disabled.
- Structural changes to buildings, parks, sidewalks, curbs,
and roads that should be made to assist the disabled.
- The mandated ADA Coordinator, the ADA grievance
process, and the necessity of documenting efforts to
ensure reasonable accommodation.

Michael J. Rose, Esq.
Rose Kallor, LLP
Attorney Rose is a principal at the law firm
of Rose Kallor, LLP. Attorney Rose advises
employers in all aspects of employment law
and civil rights statutes. He also specializes in
defending private and municipal corporations
in employment disputes. He has defended employers before
various administrative agencies, the Connecticut Superior,
Appellate and Supreme Court, the United States District Court
for the District of Connecticut, and the United States Court of
Appeals for the Second Circuit.

DIRECTIONS
FROM NEW HAVEN AND POINTS SOUTH:
Take I-95 North to Exit 66 (Spencer Plain Road/CT-166). Turn right
at end of ramp onto Spencer Plain Road. Go 0.3 miles; turn left
onto Boston Post Road (Route 1). Go approximately 1.3 miles and
turn right onto Route 154. Continue straight and the road becomes
Old Boston Post Road. Acton Library is just down the street on
the right. Parking is located behind the library. NOTE: Do NOT
turn onto "Old Post Road," which you will pass along Route 1.
This is a different road entirely from "Old Boston Post Road."
FROM NEW LONDON AND POINTS NORTH:
Take I-95 South to Exit 68. Continue straight; bear to the right
at the yield sign onto Route 1, at first light take a left onto Route
154, go to second light and take a left onto Main Street (Route
154). Follow Main Street (Route 154) through the business district
To the traffic light at Fire House (on left). At the Firehouse traffic
light take a right onto Old Boston Post Road. The Acton Public
Library is just down the street on the left. Parking is located behind
the library.
NOTE: Please park towards the rear of the parking lot.
