and enable you to plan appropriately. Proper preparation helps
reduce the burden on local government that must respond to
discovery requests involving ESI, reducing costs to local
government in manpower, insurance premiums, and sanctions.

E-Discovery & Local Government: Amendments
to Federal Disclosure Rules was developed to help

"This CIRMA workshop helps municipal leaders understand
the new rules surrounding the retention of electronically
stored information and correspondence."
LEARNING OBJECTIVES
Unfortunately, federal lawsuits against local government
related to employment issues, civil rights, Title IX and other
federal laws are becoming more common. Recent amendments
to the Federal Rules of Civil Procedure concerning the discovery
of Electronically Stored Information (ESI) will increase the
burden on local government to preserve and disclose such information.
Many recent court decisions have saddled responding parties,
such as local governments, with the cost of reproducing materials
from their technology systems, regardless of age, cost, utility,
or relevance.
More often than not, critical decisions affecting the existence,
preservation, and retention of key information are made well
before the filing and service of a lawsuit. In these situations, a
little preparedness goes a long way.
The workshop will discuss:
What is ESI?
What is E-Discovery?
Penalties for unpreparedness and ignorance of
E-Discovery/ESI issues.
How to be prepared:
Developing an E-Discovery Action Plan
Enacting and Auditing Retention Policies
Understanding and anticipating preservation or the
"Legal Hold"
Getting informed is the best way to meet this challenging issue,
which is growing in frequency and complexity.
