"If the defendant cannot prove a 'good faith' defense, lost
earnings are usually doubled as 'liquidated damages.' Since
the FLSA was seventy years ago, it is hard for employers to
prove that good faith defense."
LEARNING OBJECTIVES
Since the beginning of this decade Wage and Hour litigation has
exploded nationwide. These cases have proven to be the most
expensive to settle in the employment law area. The possibility of
double damage awards and the opportunity for collective/class
action make these claims a large liability exposure for employers.
Even when the employer acts in good faith, the complexities
surrounding the exempt and non-exempt job classifications and
leave many opportunities for error.
This CIRMA workshop is designed to help municipal and school
leaders apply best practices for compliance with Connecticut’s
wage and hour law. These best practices will help ensure that
your organization is in compliance and that your employees are
treated fairly. If a claim does occur, the practices will also help
to establish a “good faith” defense that can limit damage awards
and exposure.
Topics discussed in this workshop include:
How can you ensure that your exempt employees are
properly classified?
How to avoid defeating the exempt status of an otherwise
properly classified exempt employee?
What time is compensable time?
Can a municipality provide compensatory time in lieu of
overtime for non-exempt employees?
What is the potential exposure under state and federal
wage and hour laws?
How to build your good faith defense to avoid or reduce
liability?
