PROGRAM OVERVIEW

This program will address the key areas of labor and employment law that elected and appointed officials, members of legislative bodies, and municipal managers need to know.

A review of the basics associated with two Connecticut statutes: (1) The Municipal Employee Relations Act (MERA); and (2) The Teacher Negotiations Act (TNA), will be addressed with regard to their differences and how to work within the parameters of each.

Attendees will receive practical advice in order to effectively negotiate with employees and unions, with a focus on:

  • Preparation & Planning
  • Establishing Priorities & Ground Rules
  • The Negotiation Process
  • Mediation and Arbitration

Other issues discussed will include: understanding a collective bargaining agreement; contract language; understanding and obtaining union concessions; common human resources issues; best practices; and "what not to do" when negotiating with your unions.

This workshop is a must for any newly-elected municipal official, new or human resources officials with 3-5 years of experience, and any official involved in collective bargaining. Attendees are sure to walk away with a better understanding of the municipal labor and human resources process and be ready to lead.

You will learn the right way to address challenging situations.

LEARNING OBJECTIVES
  • Receive an overview of the key provisions of labor and employment law that municipal officials need to know to avoid costly legal errors.
  • Review a summary of the rules that apply to collective bargaining, including bargaining unit composition and exclusions, what is negotiable, the role of past practice, and the bargaining process from beginning to end.
  • Hear practical advice on how to avoid traps for the unwary when negotiating with employees and unions.
  • Learn the roles and responsibilities of the CEO, the legislative body, and the appropriating authority of the municipality for both municipal and teacher negotiations.

Ms. Murray and Mr. Roy are members of the Employer Defense and Labor Relations Practice Group of Shipman & Goodwin LLP. Both have extensive experience in representing public employers in collective bargaining, grievance arbitration and binding interest arbitration, and defending public employers in other legal proceedings. They advise public employers, including elected officials and managers, on all aspects of employee relations and employment law.
